İHRACATÇI HANGİ ŞARTLARDA YEŞİL PASAPORT ALABİLECEK?

Son 3 takvim yılı itibarıyla yıllık ortalama ihracatı 1 milyon doların üzerinde olan mal ihracatçısı firmaların temsilcilerine, ihracat tutarlarına göre değişen sayıda hususi damgalı (yeşil) pasaport verilmesine ilişkin Bakanlar Kurulu kararı Resmi Gazete’de yayımlandı.

Ekonomi Bakanlığı, 15 gün içinde firmaları belirleyerek bölge müdürlükleri ile ihracatçı birliklerine bildirecek.

Bakanlar Kurulunun bugün yürürlüğe giren “İhracatçılara Hususi Damgalı Pasaport Verilmesine İlişkin Esaslar Hakkında Kararı”na göre, son 3 takvim yılı itibarıyla yıllık ortalama ihracatı 1-10 milyon ABD doları arasında (10 milyon dolar dahil) olan firmaların bir, 10 milyon dolar üzeriyle 25 milyon dolar arasında olan firmaların iki, 25 milyon dolar üzeriyle 50 milyon dolar arasında olan firmaların üç, 50 milyon dolar üzeriyle 100 milyon dolar arasındaki firmaların dört, 100 milyon dolar üzerinde olanların ise beş yetkilisine hususi damgalı pasaport verilebilecek.

Belirtilen tutarda ihracat yapan firmaların yetkililerine, Türk Ceza Kanunu’nun ilgili maddesinde belirtilen süreler geçmiş olsa bile kasten işlenen bir suçtan dolayı bir yıl veya daha fazla süreyle hapis cezasına veya affa uğramış olsa bile devletin güvenliğine karşı suçlar, anayasal düzene ve bu düzenin işleyişine karşı suçlar, zimmet, rüşvet, hırsızlık, dolandırıcılık, sahtecilik, güveni kötüye kullanma, hileli iflas, ihaleye fesat karıştırma, edimin ifasına fesat karıştırma, suçtan kaynaklanan mal varlığı değerlerini aklama veya kaçakçılık suçlarından mahkum olmaması kaydıyla, iki yıl süreyle hususi damgalı pasaport verilebilecek.

“EŞ VE ÇOCUKLARA YOK”

Karar uyarınca, hususi damgalı pasaport alabilecek durumdakilerin eş ve çocuklarına yeşil pasaport verilmeyecek.

İlgili maddede belirtilen tutarda mal ihracatı yapan firmalar resmi dış ticaret istatistikleri esas alınarak Ekonomi Bakanlığınca belirlenecek ve her yılın 15 Şubat tarihine kadar Bakanlığın bölge müdürlükleri ile ihracatçı birlikleri genel sekreterliklerine bildirilecek.

Serbest bölgelerin yurtdışına satışları, söz konusu ihracat tutarlarının belirlenmesinde dikkate alınacak, ancak yurt içinden serbest bölgeye getirilerek üretim ve işleme faaliyetine tabi tutulmadan yurtdışına yapılan satışlar bu tutarın hesaplanmasında dikkate alınmayacak.

İADE SÜRESİ 15 GÜN

İhracatçı firmaların sahipleri, ortakları ve çalışanlarına hususi damgalı pasaport verilebilecek.

Firmanın sahip veya ortaklarının bir tüzel kişi olması halinde bu tüzel kişiliğin sahipleri, ortakları veya çalışanlarına da hususi damgalı pasaport verilebilecek.

Hususi damgalı pasaport müracaatı, İçişleri Bakanlığı ve Ekonomi Bakanlığınca müştereken belirlenen talep formu aracılığıyla yapılacak. İhracatçı birlikleri, müracaat sahibinin firma yetkilisi olduğuna ve talep formunu imzalayan firmayı temsil ve ilzama yetkili kişi/kişilerin anılan yetkiyi haiz olduklarına dair ibraz edilen belgeleri inceleyecek. İmzalanan talep formu, bölge müdürlüğünün imzasına sunulacak.

Hususi damgalı pasaport alan firma yetkilileri, hususi damgalı pasaport alabilme şartlarından herhangi birini taşımadığının sonradan anlaşılması ya da pasaportun geçerlilik süresi içinde bu şartlardan herhangi birini kaybettiği tarihi izleyen 15 gün içinde hususi damgalı pasaportlarını iade etmekle yükümlü olacak.
