BODRUM HALİKARNAS DİSKO KAYBETTİ

1979 yılında açılan Bodrum’un en gözde  eğlence yeri  Halikarnas disko için mahkeme tahliye kararı verdi. Yerin sahibi  ile işletmecilerin 17 yıldır hukuki süreç yürüttüğü söylendi.

Bodrum’un sembolü haline gelen  Kumbahçe’deki Halikarnas için 17 yıl süren hukuki dava tamamlandı. Bodrum 2. Sulh Hukuk Mahkemesi Halikarnas diskonun  tahliyesine karar verdi. Mülkün sahiplerinden Kemal Kamil Aktaş, yaptığı açıklamada  ”Ailem burasını zamanında ev olarak satın almış, daha sonraki dönemlerde pansiyon olarak işletmişler. 1979 yılında ise  Süleyman Bey’e kiralamışlar. Biz 2 defa 10 senelik kira sözleşmesi yaptık. Sözleşme 1999’da bitti. Biz 1999 dan  bu yana mülkümüzün boşaltılması için mücadele ediyoruz.” dedi.

Borçlar Kanunu’nda uzun dönem kiramalar için  bir düzenleme yapıldığını söyleyen Kamil Aktaş, “10 yılını doldurmuş kiracıların gerekçe gösterilmeden tahliye edileceği maddesi eklendi. Fakat kiracılarımız bu karara da itiraz etti ve kararın iptali için mahkemeye başvurdu. Kanuni hakkımız olduğu halde 2 yıl daha zaman harcadık , fakat sonunda müjdeli haberi aldık” dedi.

Mekanın işletmecisi olan Demir’in ailesini zor durumda bıraktığını ve tahliye sonrasında satış yapmayı  düşündüklerini belirten Aktaş, “Mülkün yarısı annem ve teyzeme, kalan kısmı ise büyük dayımın kızlarına ait. Süleyman Bey’e satmak istediğimizi de önceden bildirdikk ama çok komik rakamlar teklif etti. Tahliye yapıldıktan sonra mülkümüzü satacağız. 2 bin 900 metrekare turizm imarı olan bir alan burası. İçinde tarihi yapı var” dedi. Kira iyileştirme davaları da açtıklarını ve senelerce binananın değerinin altında kiralandığını belirten Aktaş, yıllık olarak 300 bin lira kira aldıklarını söyledi.  Denize kenarındaki mülkün 25-30 milyon dolardan satılacaı söyleniyor.

Tahliye kararından sonra  açıklama yapan, işletmeci Süleyman Demir’in avukatı Murat Yüksel ise şöyle söyledi: “Bu güne kadar kiramızı yasaların belirlediği tutarda verdik. Zaman zaman  anlaşmazlıklar olsa bile hep anlaşma sağlandı. Mülkiyetin sahibinin  çok olmasından dolayı süreç yavaş ilerliyor. Son olarak yeni bir yasanın verdiği yetki ile tahliye istediler ve biz kanunun iptali için dava açtık. Fakat Anayasa Mahkemesi mülk sahibinin lehine karar verdi ve tahliye kararı çıktı. Ancak ben mülk sahipleri  ile bir anlaşmaya varacağımızı  düşünüyorum.”

Bodrum 2. Sulh Hukuk Mahkemesi`nin verdiği kararda şu ifadelere yer aldı: “Açılan davanın kabul edilmesine, aktin sona erdiğinin tespiti ile davalının mülkten tahliyesine, davacı tarafa teslim edilmesine karar verildi.” Ayrıca kararda her iki tarafında  istinaf mahkemesine itiraz haklarının olduğu da bildirildi.
